Terms of Service
Last updated: 15 July 2026. MakeMyShot ("the Service") is operated by Rosario Vitale, sole proprietor, Genoa, Italy ("we"). By creating an account or generating content you accept these terms.
1. The service
MakeMyShot generates images and videos from your text descriptions and/or uploaded photos, using third-party AI models. Results are AI-generated content and are labeled as such, in line with EU AI Act transparency rules.
2. Credits, prices and refunds
- Generations are paid in credits. The exact credit cost is shown before every generation.
- Failed generations are refunded automatically — credits are only spent on successful outputs.
- Purchased (top-up) credits never expire.
- Unused purchased credits are refundable on request within 14 days of purchase (EU right of withdrawal); credits already spent on completed generations are consumed services and are not refundable.
3. Acceptable use
You may not use the Service to create:
- sexual or explicit content; any content involving minors;
- images or videos of real, identifiable people without their consent (including public figures and "deepfakes" — note that harmful deepfakes are a criminal offence in Italy, art. 612-quater c.p.);
- content that is illegal, defamatory, or that infringes third-party rights.
Requests are filtered automatically. Violations lead to strikes; three strikes result in a permanent ban (remaining purchased credits are refunded). You must have the rights to any photo you upload.
4. Your content and outputs
You keep the rights to what you upload. You may use generated outputs commercially, subject to the upstream model licenses and applicable law. Outputs must not be presented as authentic photographs of real events or people. Uploads are auto-deleted from our storage; outputs stay in your gallery.
5. Liability
The Service is provided "as is". AI outputs can be inaccurate or imperfect; we do not guarantee fitness for a specific purpose. Our total liability is limited to the amount you paid in the last 12 months.
